Recent years have seen increasing protest at the use of ‘greenbelt’ land for building houses on: we need new houses for people to live in, but we do not want to lose the countryside. On the other hand, ‘townies’ moving into commutable rural areas can cause much discord by their objections to country ways. The United Kingdom is very heavily populated. As we shall see, on one piece of land may live several people, and others, though they do not live on the land, may have rights over it. It is quite possible for someone who owns the title to the land to let others live there instead of himself: he may live there not knowing that others are also living on his land at the same time.
As one who finds land law fascinating, I enjoy digging back into history for its roots and connections with the social and economic changes wrought over the centuries. However, I do appreciate that students wrestling with the complexities and intricacies of this difficult subject do not share my enthusiasm! Indeed, I believe it is quite possible to learn and understand land law as it applies today (which really means after 1925) with a limited knowledge of its history and in this book I shall endeavour to keep the historical aspect of land law to a minimum.
